Tentative Ruling:
To deny. (Code Civ. Proc., § 36, subd. (e).)
Explanation:
Plaintiffs move for an order for preferential trial setting pursuant to Code of Civil Procedure section 36, subdivision (e), allowing for a preferential trial setting where a showing is made that the interests of justice will be served. The trial in this matter is currently set to begin on September 7, 2027.
The decision to grant or deny a preferential trial setting under subdivision (e) “rests at all times in the sound discretion of the trial court in light of the totality of the circumstances.” (Salas v. Sears, Roebuck & Co. (1986) 42 Cal.3d 342, 344.)
Having reviewed the moving papers and parties’ arguments, the court finds there is no basis for preferential trial setting. Accordingly, the motion is denied.
Pursuant to California Rules of Court, rule 3.1312(a), and Code of Civil Procedure section 1019.5, subdivision (a), no further written order is necessary. The minute order adopting this tentative ruling will serve as the order of the court and service by the clerk will constitute notice of the order.
