1 - Plaintiff Maya Blyth's motion to compel defendant Leal Ugrin to produce original data files and metadata for 15 photographs is granted as stated herein. Blyth represents that Ugrin has not produced data files for eight pictures that were previously bate stamped as UGRIN00008 through UGRIN00015, and produced in PDF format. (Lee Dec. 9-16; Exhs. 8 through 15.) Blyth further represents that seven of the apparent data files that were produced were not original files and do not contain any meta data. (Lee Dec. 17.)
Ugrin's counsel represents that Ugrin has made best efforts to produce the photographs in native format. Ugrin shall turn over his phone and password to an IT expert of his counsel's choosing, who shall extract and produce the photographs in native format, with all metadata intact, and produce them to Blyth's counsel. This shall occur within 30 days. Ugrin shall bear the cost. If metadata is not intact and available for production, the expert shall provide an explanatory declaration with whatever production is available. No sanctions are awarded.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
