The Petition PETITION FOR RELEASE OF PROPERTY FROM LIEN [Cal. Civ. Code 8490] filed by GLOBAL ENTERPRISES INC. on 05/05/2026 is Denied.
This is a petition by Global Enterprises Inc. dba Built Right Construction (Global Enterprises) foran orderreleasing real property located at 2166 Rheem Drive, Pleasanton, California, from amechanics lien in the amount of $23,682.76.
Global Enterprises does not appear to be the property owner. Rather, the petition states that the property is owned by Tele-Vue Systems, Inc. and Comcast Cable Communications, LLC. (See Pet. ¶ 1.) Civil Code section 8480 provides that [t]he owner of property or the owner of any interest in property subject to a claim of lien may petition the court for an order to release the property from the claim of lien if the claimant has not commenced an action to enforce the lien within the time provided in Section 8460. Because Global Enterprises does not assert any ownership interest in the subject property, it lacks standing to seek an order releasing the subject property from the lien.
This petition suffers from other procedural and pleading defects. First, the petition is unverified. (Civ. Code § 8484.) Second, the record does not contain proof of service for the petition or notice of hearing upon the respondent, Ruben Hernandez dba Rhino Concrete. (Id., § 8486(b).) Third, Global Enterprises did not provide a certified copy of the lien as required by Civil Code section 8484, and the uncertified copy attached to the petition does not bear a recording stamp indicating that the lien was ever recorded.
The petition is DENIED based on lack of standing. This order is made without prejudice to the property owners seeking appropriate relief pursuant to Civil Code section 8480 et seq.
