Tentative Ruling
NOTICE: PLEASE TAKE NOTICE that pursuant to Public Notice Civil Division Wednesday Law and Motion Calendar any oral arguments regarding this tentative ruling will be heard in Department 25, located at 720 9th Street, Sacramento, CA, the Hon. Julie G. Yap presiding. Should argument be requested by either party, the requesting party must call the Law and Motion Oral Argument Request Line at (916) 874-2615, by 4:00 p.m. the Court day before the hearing, request the hearing, and notify the opposing party of the location and time of hearing pursuant to Local Rule 1.06.
At the time of requesting oral argument, the requesting party shall leave a voice mail message: a) identifying themselves as the party requesting oral argument; b) indicating the specific matter/motion for which they are requesting oral argument; and c) confirming that it has notified the opposing party of its intention to appear and that opposing party may appear via Zoom using the Zoom link and Meeting ID indicated below. If no request for oral argument is made, the tentative ruling becomes the final order of the Court.
The Court encourages parties to appear remotely for the hearing on the tentative ruling through the Courts Zoom Application. But, any party wishing to appear in person may do so, provided that party notifies the Court by 4:00 the Court day before the hearing. TENTATIVE RULING
Respondent CSAA Insurance Exchanges (CSAA) Motion to Compel Deposition of Tasha Belfils (Deponent) pursuant to Code of Civil Procedure section 2020.240, 2023.010, and 2023.020 is ruled upon as follows.
This matter was previously continued from July 7, 2025, to rule on the merits of the motion and to permit CSAA to personally serve Deponent pursuant to California Rule of Court 3.1346. The Courts July 7, 2025 order states, Respondent shall ensure that all filings relating to the motion have been served on the non-party deponent and file proof of service regarding same. (Emphasis added.)
CSAA has filed proofs of service on July 14, 2025 indicating that its supplemental briefing was served on Deponent via email and overnight mail service. However, CSAA did not file a proof of service indicating that the entirety of the moving papers for the instant motion was served on Deponent until July 17, 2025. Further, the proof of service filed on July 17, 2025 provides that service was made by overnight delivery only, as opposed to personal service, as was required by California Rule of Court, rule 3.1346 and the Courts July 7, 2025 order. (The Court continues the hearing on this motion to July 28, 2025, to allow Respondent time to personally serve the deponent in accordance with the timelines set forth in CCP section 1005(b). [emphasis added.])
Therefore, the instant motion is DROPPED for improper service.
