The following defects must be corrected before the hearing: Proof of Service on Relatives of Proposed Conservatee. This form was adopted for mandatory use as of January 1, 2025. This form must be filed, or the proposed conservatee will be expected to attend the hearing.

Capacity Declaration (GC-335) - No order adjudging that conservatee lacks capacity to give informed consent to medical treatment may be granted unless supported by a declaration executed by a licensed physician or licensed psychologist supporting the request. (Prob. Code, Sec. 1890(c).) Please submit updated GC-335 adopted for mandatory use as of January 1, 2025.

The following must be submitted: Supplement re: Independent Powers. Petitioner requests broad independent powers pursuant to Probate Code section 2590-91 that are not supported by factual allegations showing good cause to overcome the duty to provide all support of the minor pursuant to Family Code sections 3900 and 4053(a). The current proposed order and letters indicate petitioner, and attorney for same, either do not understand, or fail to acknowledge this duty owed by the Petitioner to the minor. Thus, good cause must be presented to justify any deviation from Local Rule 1735, which requires the funds be placed into a blocked account.
