Petitioner Alanna Zabielski's motion for relief from an order confirming an arbitration award is denied. The court exercises its discretion to consider Zabielski's untimely motion, which was set with insufficient notice. Respondent Airbnb shows no prejudice. However, Zabielski's reply brief is overlength and the court disregards all pages past the tenth page of substantive briefing. (Rule of Court, 3.1113, subd. (d).)
On the merits, the court denies the motion under both Code of Civil Procedure, Sec. 473, subdivision (b), and Code of Civil Procedure, Sec. 1008. Zabielski was aware of her concern that the arbitrator accessed her social media by February 2026 (Zabielski Decl., Ex. 7) but did not present that concern in her petition to vacate and offers no satisfactory reason for the omission. In any event it does not appear to the court that this fact would have changed the outcome on her motion to vacate.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
