Ruling

CASE NUMBER: 23PB-0032172 This matter is on calendar for Status of Administration and for hearing on an Order to Show Cause Re: Monetary Sanctions issued to the Personal Representative and Counsel for failure to timely close the estate administration. A response to the Order to Show Cause has been filed. A Petition for Preliminary or Final Distribution has been filed. The Court will VACATE the Order to Show Cause and will not impose sanctions.

This matter is also on calendar for hearing on the Report of Personal Representative and Petition for Preliminary or Final Distribution. The matter has not been properly noticed. There is no proof of service of the Notice of Hearing and Petition for any parties entitled to notice. The Court notes the proposed distribution does not match the will. Article II, item A(4) of the will states that Ryan Delgado is to receive 1⁄4 portion of Jorge Delgado’s share of the estate. Therefore, Ryan Delgado is entitled to 6.25% of

Jorge’s portion of the estate and Jorge is entitled to the remaining 18.75% of his 25% share. Additionally, no waiver of the requirement of an accounting has been filed.

The matter is continued to Monday, July 13, 2026, at 2:30 p.m. in Department 44 for further proceedings on the Petition for Preliminary or Final Distribution. An amended Petition is required to be filed to address the issues raised above. Petitioner is also required to file and serve a new Notice of Hearing for the continued hearing date, along with a copy of the amended Petition, on all parties entitled to notice. No appearance is necessary on today’s calendar.
