PETITION TO CONFIRM CONTRACTUAL ARBITRATION AWARD
TENTATIVE RULING:
The hearing on Plaintiff’s unopposed Petition to Confirm Arbitration Award is continued to July 28, 2026 at 2:00 p.m. in Department 4.
Plaintiff has not filed any proof of service establishing that Defendant was served with plaintiff’s Petition. Plaintiff shall serve defendant by June 9, 2026 and file a proof of service no later than July 14, 2026.
The court notes that on March 18, 2026, the clerk of the court mailed notice of the hearing date for this motion to defendant. However, the defendant’s apartment number in the mailing address was not included, and the notice was returned to the court as undeliverable. While a street address alone, at least for a business address, is sufficient even if the floor or suite number is omitted (Cal. Prac. Guide Civ. Pro. Before Trial § 9:86.6 (June 2025 update) [citing Jackson v. Bank of America (1983) 141 Cal.App.3d 55, 58, 190]), the better practice is to include the apartment number.
In the interest of fairness and justice, a continuance is necessary to have the notice of the hearing re-served at 244 North Ellsworth Ave., Apt. 8, San Mateo.CA 94401. The clerk of the court is to revise defendant’s address in the court file to include the apartment number and to mail notice of the hearing to defendant at her address, which includes the apartment number.
Accordingly, the hearing for Plaintiff’s Petition to Confirm Arbitration Award is continued to July 28, 2026 at 2:00 p.m. in Department 4.
If the tentative ruling is not contested, it shall become the order of the court without the need for a formal order.
