Julie G. Yap presiding. Should argument be requested by either party, the requesting party must call the Law and Motion Oral Argument Request Line at (916) 874-2615, by 4:00 p.m. the Court day before the hearing, request the hearing, and notify the opposing party of the location and time of hearing pursuant to Local Rule 1.06.

TENTATIVE RULING

Defendant and Cross-Complainant Jacque Chokrola Ojadidi’s (“Ojadidi”) Motion to Quash Service of Summons is DROPPED for defective service.

Ojadidi has filed no proof of service indicating that service was performed on any of the other parties to the instant action. Defective service deprives the court of jurisdiction. (Lee v. Placer Title Co. (1994) 28 Cal.App.4th 503, 509.) Further, Ojadidi cannot cure this defect by filing any proof of service (assuming Ojadidi had timely served the other parties) given that no proof of service for this motion can be filed at this late juncture. (CRC Rule 3.1300(c) [“[p]roof of service of the moving papers must be filed no later than five court days before the time appointed for the hearing”].)
