Request for Order - Child Custody/Visitation; Case Progress Conference
Petitioner Fidelia Del Socorro Davila Arauz (Mother) filed a request for order (RFO) for sole custody of the minor child Maricela. Originally, she failed to serve Respondent Carlos Omar Reyes Diaz (Father). Now both parents have been interviewed by Family Court Services, and the Court finds it is in the best interest of the minor child to adopt the recommendation in full as set forth below:
1. Joint legal custody. The parents shall share responsibility and confer in good faith on matters concerning the health, education, and welfare of Maricela. Each parent shall have access to Maricela’s school, medical, mental health, and dental records and the right to consult with professionals who are providing services to her.
2. Joint physical custody.
3. Parental Timeshare: Maricela shall be in the custody of her parents on an alternating week schedule from Wednesday to Wednesday. Exchanges shall occur with Maricela’s babysitter.
4. Holidays: shall be arranged per mutual parental agreement.
5. Father shall not call Mother late at night requesting to speak with Maricela after Maricela’s bedtime.
6. All communication between parents shall be civil and respectful in nature.
7. Parents shall keep one another informed of medical or other appointments made for Maricela and shall share information from the appointment with one another.
8. Parents may modify any portion of this parenting plan at any time per mutual parental agreement.
The case is continued for Case Progress Conference to July 7, 2026, at 1:30 in Department G.
