Defendants Kimberly Woodruff and David Woodruff’s motion to quash third party subpoena is DENIED as moot.
Plaintiff has withdrawn the subpoena Defendants seek to quash. Accordingly, there is no pending subpoena for the Court to quash.
This motion remains on calendar, however, because Defendants seek monetary sanctions. Additionally, Plaintiff seeks sanctions. Plaintiff argues it is entitled to sanctions due to Defendants’ refusal to withdraw the motion after the challenged subpoena was withdrawn.
The court declines to award monetary sanctions to any party.
