There are triable issues of fact as to how title is vested, the character of the disputed property and who owns the property.

Cross-Petition for Instructions: In a Petition for Instructions the court does not take the place of the executor. The executors request is essentially asking the court to tell the executor what to do. Executor is to inform the court of the options, with the anticipated outcomes, and then inform the court what the executor plans to do. Then the court either approves or rejects the proposed action.
Here executor is requesting a declaratory judgment from the court before they act, and/or asking the court to tell them how to act at the courts discretion. Executor is to provide the court, and the parties entitled to notice, a request via a Petition for Instructions as to what the executor believes is the best action to take.
The court intends to dismiss cross-petition for instructions without prejudice.
