Case Progress Conference; Request for Order – Child Support
Alonya Trish Van Rooyen (Mother) filed a request for child support and spousal support orders on April 17, 2026. Jean Claude Van Rooyen (Father) filed a responsive declaration May 6, 2026, disputing certain assumptions and values in Mother’s request and acknowledging his responsibility to provide child support. There are no orders currently in place.
The Petition for Dissolution was filed October 23, 2025. The parties were married on December 16, 2009. They have two children: Maya Ariana (DOB 4-5-2013) and Jamie Jean (3-21-2015). Under Marin Superior Court Local Rule 7.13, in all proceedings where child or spousal support is an issue, in addition to filing completed Income and Expense Declarations, each party is required to serve on the opposing party and lodge (under seal) copies of the party’s two most recent state and federal income tax returns and W2s. Both parties have submitted Income and Expense Declarations. Neither party filed their tax returns. Mother only filed one year of W2s. The parties are directed to comply with Local Rule 7.13 within 30 days of the entry of this Court’s order.
The parties have provided this Court with completed Income and Expense Declarations with some supporting documentation that enables this Court to calculate on a provisional basis, guideline child support and spousal support. This order is denominated as “provisional” as it may be amended when the parties provide more detailed and complete supporting information.
Assumptions and inputs in calculating guideline support
Under California law, “guideline support” is calculated using a mandatory statewide formula. In implementing the statewide uniform guideline, courts adhere to the principles set out in the Family Code. Child support is calculated first using net incomes and timeshares. Under Family Code section 4053(c), the guideline “takes into account each parent’s actual income and level of responsibility for the children.” With this framework in mind, the Court addresses the key assumptions and inputs. The printout of the actual calculation is attached to this order.
Timeshare. Consistent with the parties’ representations, the Court applies a 80/20 custodial timeshare.
Reported monthly income. Mother ($5832 + $4498); Father ($13564)
Healthcare. Mother ($325); Father ($550)
Add-on expenses related to childcare. Each party $250.
As authorized by CRC Rule 5.125, the Court shall prepare the Findings and Order After Hearing.
Parties must comply with Marin County Superior Court Local Rules, Rule 7.12(B), (C), which provide that if a party wants to present oral argument, the party must contact the Court at (415) 444-7046 and all opposing parties by 4:00 p.m. the court day preceding the scheduled hearing. Notice may be by telephone or in person to all other parties that argument is being requested (i.e., it is not necessary to speak with counsel or parties directly.) Unless the Court and all parties have been notified of a request to present oral argument, no oral argument will be permitted except by order of the Court. In the event no party requests oral argument in accordance with Rule 7.12(C), the tentative ruling shall become the order of the court.

IT IS ORDERED that evidentiary hearings shall be in-person in Department B. For routine appearances, the parties may access Department B for video conference via a link on the court website. Litigants in the virtual courtroom are required to leave the video screen on and wait for your case to be called.
FURTHER ORDERED that the parties are responsible for ensuring that they have a good connection and that they are available for the hearing. If the connection is inadequate, the Court may proceed with the hearing in the party’s absence.
