Seaview Insurance Company (the Surety) through its agent Aladdin Bail Bonds posted bond (SV100-5411163) on behalf of a Senen Santiagoperez (Defendant). On January 15, 2025, Defendant failed to appear and the Court ordered the bond forfeited. On September 15, 2025, the Court granted an extension of the forfeiture to December 14, 2025. On February 23, 2026, the Court granted a second extension to March 14, 2026, a Saturday.
On Monday, March 16, 2026, the Surety submitted a motion to exonerate the bond. The motion was rejected on the grounds it had been submitted after the forfeiture date. Summary judgment was entered on the bond that same day. The Surety seeks to set aside summary judgment and exonerate the bond.
Notice of the motion is deficient. The proof of service was filed contemporaneously with the motion, meaning when served, the notice of motion did not include the hearing information which is assigned by the Clerk’s Office at the time of filing. (Cal. Rules of Court, rule 3.1110(b); Local Rule 7.05.1.) The motion will be continued for proper notice.
