All hearings currently scheduled or reserved after the effective date shall remain in place and will be heard in Department 16C.

TENTATIVE RULING:
Defendant in pro per Crystal R. Polands (Defendant) motion to compel arbitration is UNOPPOSED, but DENIED without prejudice.
The entirety of Defendants memorandum of points and authorities states the following.
Plaintiffs claims arise from a cardmember agreement containing a binding arbitration clause. Plaintiff, as an alleged assignee, is bound by that clause. Arbitration is mandatory under the Federal Arbitration Act.
Defendant then attaches Exhibit A and Exhibit C to the motion without authenticating either document.
This is wholly insufficient. Defendants motion completely fails to satisfy her burden to demonstrate the existence of a valid agreement to arbitrate between the parties. Plaintiff sets forth no relevant legal authority, well-reasoned argument, or evidence in support of

her motion. Thus, the motion is DENIED without prejudice.
The notice of motion does not provide notice of the Courts tentative ruling system, as required by Local Rule 1.06. Defendant is directed to contact Plaintiff and advise of Local Rule 1.06 and the Courts tentative ruling procedure and the manner to request a hearing. If Defendant is unable to contact Plaintiff prior to hearing, moving counsel is ordered to appear at the hearing.

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk.
