1. Guardianship of Mariah A 25PR0312 PETITION TO APPOINT GUARDIAN
A Petition to Appoint a Guardian and Temporary Petition was filed on November 6, 2025. Letters of Temporary Guardianship were issued on December 3, 2025. Due to defective service, the court continued the initial hearing on January 7, 2026 to February 11, 2026 and reissued the temporary guardianship with new letters. The court received the probate investigator report on December 31, 2025 which recommends that the petition be granted. The court has not received the Department of Justice background results.
There are no notices of hearing for any individuals entitled to notice. Proposed guardians request that the court dispense with notice to the biological parents. It appears that since the filing of the petition the biological father has come back into Mariah’s life, which the court infers means that the proposed guardians may now have contact information for him. Upon review of the file, the court finds that the father has only been served by mail, not personally as required by the code. As to the biological mother, it appears that she has consented to the guardianship and waived notice of the hearing.
While the court finds that the guardianship appears to be necessary and appropriate, the court orders appearances to resolve the notice issues.
