Ruling

2024CUPA031399: MICHAEL SWANN vs SPENCER PENHART 05/22/2026 in Department 42 Motion to be Relieved as Counsel

Motion: Attorney Jessica S. Williams’ Motion to Be Relieved as Counsel Tentative Ruling: The Court CONTINUES Attorney Jessica S. Williams’ Motion to Be Relieved as Counsel in order to allow the filing of proper proofs of service. The hearing is continued to June 23, 2026 at 8:30AM, and Attorney Williams shall give notice of the continued hearing date and shall file proof of service with the Court. Counsel is directed to California Rule of Court, rule 3.1362 (d). While the declaration of attorney Williams states that Plaintiff/client was served “by mail at the client’s last known address with copies of the motion papers served with this declaration” after confirming the address “by conversation” (¶¶ 3.a.(2) and 3.b.(1)(c)), the actual proofs of service attached to the form Notice, Motion and Proposed Order all indicate that service was only made by “electronic mail” on April 22, 2026.

No email is listed for Plaintiff Michael Swann; only his physical address in Port Hueneme.
