The unopposed petition to confirm arbitration award and award fees and costs is granted for good cause shown in the moving papers. Petitioner Northern California District Council of Laborers shows that an award was entered, and respondent Paulson Cox Construction, Inc. has failed to satisfy it. Respondent has not presented justification for its failure to pay the award. The court finds bad faith. (See International Union of Petroleum and Indus. Workers v. Western Indus. Maintenance, Inc. (9th Cir. 1983) 707 F.2d 425, 429 [concluding award of fees was proper where "absent justifiable grounds for asserting invalidity, the arbitrator's decision and award was final and binding.
The award set forth clear legal rights which the company refused to satisfy. This refusal gave rise to the necessity to petition the district court for enforcement of that right with the attendant delay and expense."].)
The amount of fees requested, $3410.40, is reasonable both in the number of hours billed and the hourly rate. The cost bill presents items of cost that are reasonable on their face. Petitioner shall submit a proposed judgment.

Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
