Approve account and report. Approve statutory compensation of $7,700.98. Approve statutory attorney fees of $7,700.98. Approve reimbursement to attorney in the amount of $5,424.80. of which $2,759.48 has been reimbursed, leaving a balance due of $2,665.32.

Approve a closing reserve of $10,000.00. Administrator is ordered to file a noticed, supplemental accounting of the reserve before discharge. (Local Rule 10.04(J))

Proposed distribution: Petitioner states she is the registered domestic partner of decedent and proposes distribution of 1/3 of the estate to her and 1/9 each to decedent’s six children (Armando’s share less the $635.80 to CalVCB).

Probate Code §37 (a) “Domestic partner” means one of two persons who have filed a Declaration of Domestic Partnership with the Secretary of State pursuant to Division 2.5 (commencing with Section 297) of the Family Code, provided that the domestic partnership has not been terminated pursuant to Section 299 of the Family Code. (b) Notwithstanding Section 299 of the Family Code, if a domestic partnership is terminated by the death of one of the parties and Notice of Termination was not filed by either party prior to the date of death of the decedent, the domestic partner who survives the deceased is a surviving domestic partner, and shall be entitled to the rights of a surviving domestic partner as provided in this code.

A domestic partner has the same right to inherit as a spouse under Section 6401(c).

The California Secretary of State states: A certified copy of the file stamped Declaration of Domestic Partnership is sufficient to substantiate the registration of the partnership. An entity requiring proof of Domestic Partnership should accept a certified copy of the Declaration of Domestic Partnership.

A certified copy will contain a purple stamp on the back of the document containing the California State Seal and initials. Certified copies of the filed Declaration of Domestic Partnership are available at the time of registration for

an additional fee or can be ordered after registration by submitting a Special Filings Records Order Form or Confidential Records Order Form (for Confidential Domestic Partnerships).
