Hearing on Parkfront's Petition to Vacate Real Estate Arbitration Award. Parkfront's Petition is DENIED. The Arbitrator did not exceed their authority under CCP Section 1286.2(a)(4). It does not arbitrarily rewrite or violate the lease for the Arbitrator to find one estimate to be "more accurate" than another for multiple reasons, only one of which is related to an interpretation of the lease. The Court notes that the Arbitrator also did not "entirely agree" with the reasoning underlying the estimate that it adopted; the Arbitrator's task was to pick the better of two estimates.
Conversely, Kokkari's request to confirm the arbitration award is GRANTED. Although the Court has taken Kokkari's Petition off calendar, Kokkari's timely filed Opposition requests to confirm the arbitration award, which this Court has the authority to grant. (See C.C.P. Section 1285.2). =(501/GLW)
