First, nothing in CCP 1281.2, subds. (c) or (d) authorizes the court to bar Plaintiffs from enforcing an arbitration agreement against Intervenor when no one petitioned this court to compel arbitration in the first place.
Second, the Court does not find that Intervenor met the elements required for permissive or mandatory intervention, namely, Intervenor has not shown he has a direct interest in the instant litigation or an interest relating to the property or transaction that is the subject of the action that may be impaired by a disposition in the action. (CCP 387(d)(1), (2).)
