Ruling
Real Property/Housing Court Law and Motion Calendar for June 5, 2025 line 4. PLAINTIFF DAVID GUTEKUNST, TRUSTEE OF DAVID C. GUTEKUNST LIVING TRUST DTD 6/25/04 MOTION TO CONSOLIDATE ACTIONS OF CASE(S) CGC-24-617761, CGC-25-622782 WITH CASE CGC-24-614383 is GRANTED IN PART AND DENIED IN PART.
614383 and 617761 are consolidated for all purposes with 614383 as the lead case and all future filings in both cases to be only in 614383. The portion of the motion seeking to consolidate 622782 with the other two cases is denied without prejudice to being re-filed if Gutenkunst's motion to intervene in 622782 is granted.
Good cause has been shown for the consolidation of 614383 with 617761 and no opposition has been filed to the consolidation of those two cases. It is premature to rule on the consolidation of 622782 with the other two cases at least until there is a ruling on Gutenkunst's motion to intervene. If Gutenkunst is not permitted to intervene in 622782, consolidation of all three cases dis-serves judicial economy. The court makes no ruling or comment on whether, if Gutenkunst is permitted to intervene in 622782, that case should be consolidated with the other two cases. =(501/HEK)

Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests. A party may not argue at the hearing if the opposing party is not so notified and the opposing party does not appear. | |
