PLAINTIFF DAVID STANTON AN INDIVIDUAL MOTION FOR SUMMARY JUDGMENT / AMENDED NOTICE OF HEARING ON PLAINTIFFS MOTION FOR SUMMARY JUDGMENT OR, IN THE ALTERNATIVE, SUMMARY ADJUDICATION OF CLAIMS is DENIED.
There are triable issues of fact regarding the amount of money owed and Defendant's affirmative defenses. Defendant claims that Plaintiff breached the contract, prevented Defendant's performance, and has unclean hands. With all reasonable inferences made in Defendant's favor, Defendant's evidence raises questions of fact regarding whether the breaches were material, whether performance was impossible, and whether Plaintiff committed the acts that constitute unclean hands. =(501/CFH)
