Plaintiff Santos Quintal's unopposed Motion For Preliminary Approval Of Class Action And PAGA Settlement is GRANTED IN PART AND DENIED IN PART.
Good cause appearing, the court: (1) preliminarily approves the proposed settlement of this class action with Defendants Sasala Dining USA Inc. and Masao Kuribara ("Defendants"); (2) for settlement purposes only, conditionally certifies the Class, which is comprised of "all non-exempt employees who were worked for Sasala Dining USA Inc. as a non-exempt employee during the Class Period"; (3) provisionally appoints Plaintiff as the representatives of the Class; (4) provisionally appoints Matthew A.
Haulk and Jose M. Herrera and Haulk & Herrera LLP as Class Counsel; (5) approves the form and method for providing class-wide notice; (6) directs that notice of the proposed settlement be given to the class; (7) appoints ILYM Group, Inc. as Administrator, and (8) sets a final approval hearing date for October 23, 2025, at 9:00 am in this department, for which Plaintiff shall file and serve a timely noticed motion for final approval of settlement, with courtesy copy delivered to the department within 24 hours of filing and opposition may be in writing or heard at the hearing.
To the extent Plaintiff seeks different or additional relief, the motion is denied. Much of the relief requested but not granted is not necessary or appropriate for preliminary approval.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for Plaintiff is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
