Defendants Jianqiang Li and Jennifer Tang Liang's motion to compel further production of documents is granted in part and denied in part. Plaintiff Salam Abdulsahib is ordered to produce all documents responsive to categories 1 through 9 and 11 through 14 in the deposition notice that are currently in his possession, custody, or control to Defendants to the extent he has not already done so, except that Abdulsahib is not required to produce tax documents, which duplicate information in the wage statements and are subject to separate privacy concerns. Abdulsahib shall make full production within 10 days of this order but is not required to obtain copies of documents that are not already in his or his attorneys' possession.
The court finds good cause for this order. Documents related to his medical conditions and past earnings plainly relate to his injuries and the extent of his future wage losses. It is immaterial that Abdulsahib is not claiming past wage losses because past earnings bear on future earning capacity. Abdulsahib's counsel's objections were late and his attorney's statement of compliance is ambiguous as to some categories of documents. The court balances the need for this discovery against its burdens and the time left before trial.
Ordinarily, sanctions would be appropriate on a discovery motion absent extenuating circumstances. Here, Li and Tang Liang's motion did not include a code-compliant separate statement which impeded the court's review. The court finds both parties' positions to lack substantial justification and does not award sanctions.
