DISCUSSION Plaintiffs TaxAnxiety.com Inc. and Rick Cordell, Trustee for Roseberg-Cordell Trust ("Plaintiffs") move for an order authorizing service of the summons and complaint upon defendant Ishaan Dalal ("Defendant") by electronic means, specifically by electronic mail to ish.aand@gmail.com. "[I]f a plaintiff, despite exercising reasonable diligence, has been unable to effect service of the summons by any of the methods authorized under this chapter, the court in which the action is pending may, upon motion, direct that summons be served in a manner that is reasonably calculated to give actual notice to the party to be served, including by electronic mail or other electronic technology, and that proof of such service be made as prescribed by the court." (Code Civ.
Proc., Sec. 413.30, subd. (a)(1).) "A plaintiff seeking to establish reasonable diligence under this section shall set forth facts detailing all attempts to serve the defendant by each of the methods prescribed by statute, including facts demonstrating why each method was unsuccessful at every address or location where the defendant is likely to be found." (Code Civ. Proc., Sec. 413.30, subd. (a)(2).) The court finds that Plaintiffs have established reasonable diligence because (1) Plaintiffs attempted personal service on eight separate occasions between March 27, 2026 and April 24, 2026, at Defendant's known residence (Chuah Decl., P. 4, Ex.
A), (2) Plaintiffs were unable to serve Defendant by substitute service because, on the eight separate occasions that personal service was attempted, no one answered the door at Defendant's residence (Chuah Decl., P. 5), (3) on March 12, 2026, Plaintiffs served the summons and complaint on Defendant by mail with the notice and acknowledgment of receipt addressed to Defendant at his residence, but Defendant did not return a signed acknowledgment of receipt and thus Plaintiffs were not able to complete service by mail with acknowledgement. (Chuah Decl., P. 6.) (Code Civ.
Proc., Sec.Sec. 415.10, 415.20, 415.30.) Plaintiffs have also shown they conducted skip-trace and investigative efforts to locate any additional address or whereabouts of Defendant, but those efforts confirmed that Defendant is only associated with his known residence which is the same address as his address of record on his court filings. (Chuah Decl., P. 7.) The court finds that electronic service is reasonably calculated to give actual notice because that is the email address Defendant used to serve documents on Plaintiffs in this action and that is the email address Defendant has stated on his previous court filings. (Chuah Decl., P. 8; 12/09/24 Motion to Quash; 07/11/25 Motion to Quash.)
