Procedural History 18 1) The parties are Petitioner Michelle Bonilla Dold and Respondent Lars Georges Marie-Josee 19 Huyghe. 20 2) On 10/14/25, Petitioner filed a Petition for Dissolution indicating the date of marriage is 12/14/19 21 and date of separation is 5/7/25 for a marriage of 5 years and 4 months. 22 3) On 12/31/25, Respondent filed a Response and Request for Dissolution indicating the date of 23 marriage is 12/14/19 and date of separation is 5/7/25 for a marriage of 5 years and 4 months. 24 4) On 6/18/26, Respondent filed a Request for Order seeking guideline temporary monthly spousal 25 support, $10,000 in Family Code section 2030 attorney’s fees, and return of personal property left 26 at the marital residence.
Respondent asserts that there is significant disparity in income and 27 access to funds between the parties and Respondent’s income has varied because he was on 28 medical leave from May-November 2025, and then he went on disability in May 2026 due to a 29 broken leg.
1 5) Respondent filed an Income and Expense Declaration, which is file dated on 6/3/26. 2 6) Respondent also filed a declaration of counsel substantiating his request for $10,000 in Family 3 Code section 2030 attorney’s fees and costs, which is file dated 6/11/26. 4 7) On 6/25/26, Respondent filed a Proof of Electronic Service indicating counsel for Petitioner was 5 served by email on 6/25/26. The Court notes there is no indication that Respondent’s Income and 6 Expense Declaration was served. 7 8) On 8/24/26, Respondent filed a Statement of Support Calculations. 8 9) On 8/24/26, Respondent filed a Proof of Electronic Service indicating Respondent’s Statement of 9 Support Calculations was served on counsel for Petitioner by email on 8/24/26. 10 10) On 8/27/26, Petitioner filed an Income and Expense Declaration. 11 11) There is no Proof of Service on file indicating Petitioner’s Income and Expense Declaration was 12 served on Respondent. 13 12) Petitioner did not file a Responsive Declaration. 14 B.
Findings and Order 15 1) Respondent’s unopposed request for guideline monthly spousal support is GRANTED. 16 2) The Court finds good cause to adopt Respondent’s Statement of Support Calculations filed 17 8/24/26, which are attached hereto and incorporated herein. 18 3) For the period of 6/18/26 (i.e., the filing date of the Request for Order) – 9/31/26, Petitioner shall 19 pay Respondent $3,090 in temporary monthly spousal support. See XSpouse “Exhibit A.” 20 4) This means that Petitioner owes Respondent a total of $10,506 in spousal support arrears for the 21 period of 6/18/26 – 9/31/26 ($1,236 for June + $9,270 for July – September).
Petitioner shall pay 22 this balance in full by 10/10/26. 23 5) Commencing 10/1/26 (i.e., when Respondent anticipates returning to work fulltime after 24 disability), Petitioner shall pay Respondent $2,672 in temporary monthly spousal support by the 25 1st of every month. See XSpouse “Exhibit B.” 26 6) Respondent’s request for $10,0000 in Family Code section 2030 attorney’s fees is GRANTED. 27 7) The Court finds an award of attorney's fees and costs is appropriate here because there is a 28 demonstrated disparity between the parties in access to funds maintain counsel and, in the ability, 29 to pay for legal representation.
1 8) The Court further finds Petitioner is reasonably likely to have the ability to pay for legal 2 representation for both parties and $10,000 in fees and costs are reasonable and necessary. 3 9) Petitioner shall pay Respondent this balance in full by 11/10/26. 4 10) The Court reserves jurisdiction over allocation and characterization of this fee award. 5 11) The parties shall meet and confer regarding the return of Respondent’s personal property items 6 that were left in the marital residence. 7 12) Counsel for Respondent shall prepare the Findings and Order After Hearing. 8 13) Preparation of Order: If you are directed by the court to prepare the order after hearing – within 9 10 calendar days of the hearing you must either: (a) Serve the proposed order to the other 10 party/counsel for approval, and follow the procedures set forth in CA Rules of Court, Rule 11 5.125(c), or (b) If the other party did not appear or the matter was uncontested, submit the 12 proposed order after hearing directly to the court. Failure to submit the order after hearing within 13 10 days may allow the other party to prepare a proposed order and submit it to the court in 14 accordance with CA Rules of Court, Rule 5.125(d). 15
