Probate Advance makes a request, pursuant to Probate Code section 9703 to order that the personal representative shall establish a blocked account pursuant to the Blocked Account Agreement; That all Estate funds, now and in the future, shall be deposited by the personal representative and heir in the blocked account and withdrawn only upon order of the Court pursuant to the Blocked Account Agreement
Kristie Lee Miller was appointed executor of the estate, with full IAEA powers and bond waived.
Executor is opposed to such an order and there are no grounds to grant the petition. Probate Code section 9703 allows the personal representative to file an application for an order that money be deposit into a blocked account.
Probate Advance has provided no facts that would warrant the necessity to require a blocked account.
The fact that a beneficiary has signed a Blocked Account agreement has no power over the personal representative and does not require the executor to make such an application.
The court intends to deny the petition.
