Defendants' Motion for Protective Order and/or Case-Management Discovery Order is DENIED without prejudice. First, Defendants cite no authority for the appointment of the "neutral facilitator" requested, as Defendants specifically clarify that this person would not be referee authorized under CCP 639. Second, Defendants have not provided the Court with either the discovery requests nor the responses at issue. With no ability to review or refer to the discovery, the Court cannot determine whether justice requires the requested protective order, which would broadly and preemptively restrain Plaintiff from seeking relief, to protect Defendants from unwarranted annoyance, embarrassment, oppression, or undue expense. (See CCP 2030.090(b), 2031.060(b).)

Any period for Plaintiff to bring a motion regarding the subject discovery is tolled from July 9, 2026 to September 9, 2026. This matter will be heard in department 505 by the Honorable Michelle Tong at 1:30 p.m. per the order of the presiding judge. =(501/MT)
