RESOLUTIONS INVESTMENTS, LLC vs JUAN RIOS Tentative Ruling: The Court has read and reviewed the moving papers filed by Plaintiff Absolute Resolutions Investments, LLC ("Plaintiff"), including the supporting declaration. The Court takes judicial notice of the Settlement Agreement with Mutual Release and Stipulation for Entry of Judgment Upon Default ("Stipulation") signed by Defendant on July 3, 2024 and filed with the Court on June 25, 2026 with Plaintiff's moving papers. The Court also takes judicial notice of the Notice of Settlement of Entire Case filed with the Court on August 13, 2024. The Court notes that Plaintiff has advised that Defendant has made payments totaling $266.00.
Based on the Stipulation signed by the parties and the moving papers submitted by Plaintiff, Plaintiff's motion is GRANTED. Judgment is hereby entered in favor of Plaintiff Absolute Resolutions Investments, LLC and against Defendant Juan Rios for the principal sum of $1,594.04 plus court costs of $516.90, for a total judgment of $2,110.94. 25NWLC64304: CAPITAL ONE N.A. vs JUANITA GONZALEZ Tentative Ruling: The Court has read and reviewed the moving papers filed by Plaintiff Capital One, N.A. ("Plaintiff"), including the supporting declaration. The Court takes judicial notice of the Stipulation Agreement; Jurisdiction Retained Under Code of Civil Procedure Section 664.6 signed by Defendant on November 25, 2025 and filed with the Court on December 11, 2025. The Court also takes judicial notice of the Order on Settlement Agreement and Stipulation for Judgment entered by the Court on January 14, 2026. The Court notes that Plaintiff has advised that Defendant has made payments totaling $1,492.00, leaving an outstanding amount of $2,458.00 due and owing.

25NWLC67769: LVNV FUNDING LLC vs DERRICK GREINER Tentative Ruling: The Court has read and reviewed the moving papers filed by Defendant Derrick Greiner ("Defendant"), including the supporting declaration. Defendant filed its Motion to Quash Service of Summons ("Motion") on August 17, 2026 along with a Proof of Service. The Proof of Service indicates service by mail on Plaintiff LVNV Funding LLC ("Plaintiff") on August 16, 2026. No opposition has been filed by Plaintiff.
Code of Civil Procedure section 1005 requires that "all moving and supporting papers shall be served and filed at least 16 court days before the hearing. . . . if the notice is served by mail, the required 16-day period of notice before the hearing shall be increased by five calendar days if the place of mailing and place of address are within the State of California." For proper notice to have been given by Defendant, this motion should have been served no later than August 12, 2026 for a hearing date on September 9, 2026.
The Court continues the hearing on the Motion to September 24, 2026 at 10:30 a.m. in Dept. Y so that Plaintiff has sufficient time to file an opposition if necessary. Clerk to give notice.
