Notice is insufficient. Probate Code §851 requires notice to all persons claiming an interest in or having title to or possession of the property. Per the Grant Deed attached to the petition as Exhibit C, John A. Vaiz is a joint tenant owner of the property. Petitioner to serve the Notice of Hearing on Petition to Determine Claim to Property (DE- 115) to the persons and entities in the manner provided in Probate Code §851, and, specifically, 30 days personal service as to John A. Vaiz is required.
The court will continue the hearing to 11/12/26 at 9:00 a.m. in Department J6.
Counsel for Petitioner, Mr. Ridley, is required to appear and discuss with the Court. Petitioner to provide notice of future court date.
