Real property sales proceeds (cash) were invested in a U.S. Bank Private Wealth Management Brokerage Account and this account is included on Schedule “F” of the Accounting as property on hand at the end of the accounting period.

Petitioner provides no authority for the investment in a brokerage account and did not obtain court approval for such an investment. Further, a brokerage account is not an investment that would be approved by the court. (See Probate Code §9730; §9731)

Discuss.

Upon resolution of the investment issue, the court intends to:

Approve the First Report and Account.

Approve the request to waive the requirement for details for receipts when it proves impossible to ascertain in the First Account.

Authorize petition to omit the source of deposits, prior to April 1, 2025, in future accounts when it proves impossible to ascertain.

Accept the Assignment of Interest to the Sisters of the Presentation of the Blessed Virgin Mary of Dubuque, Iowa, executed by Petitioner/Administrator/Heir, Mary Louise Scieszinski.

Approve the Preliminary Distribution and that the following assets of the estate be distributed as follows: (1.) Preliminary distribution from the estate bank accounts: $1,541,125.00 cash to Joseph Scieszinksi. (2.) Preliminary distribution from the estate as follows: The estate’s stock holdings and brokerage account to total $1,541,125.00 to The Sisters of the Presentation of the Blessed Virgin Mary of Dubuque, Iowa.

Bond to be set at $3,188,250.00.
