Defendant's Motion to Compel Nonparty La Raza Community Resource Center to Produce an Authenticated Copy of Electronically Stored Information and for Order Imposing Monetary Sanctions Against Nonparty La Raza Community Resource Center is GRANTED in part, subject to opposition.
Within 5 days of service of notice of entry of this order, nonparty deponent La Raza Community Resource Center, Inc., is ordered to produce the records described in the Deposition Subpoena for Production of Business Records, served July 14, 2025, together with the affidavit required by California Evidence Code section 1561. The records and affidavit shall be produced to the deposition officer designated in the subpoena.
Monetary sanctions are denied at this time, as defendant has not provided any receipts or documentation of the claimed costs, and the proofs of service provided to the Court do not reflect any fees for service of this motion.
However, pursuant to California Code of Civil Procedure section 2020.240, should the nonparty deponent disobey this court order, the nonparty deponent may, in the Court's discretion, be punished for contempt, including but not limited to forfeiture and damages as specified in California Code of Civil Procedure section 1992. =(501/CFH)
