Defendant's Motion to Reclassify Case from Unlimited Jurisdiction to Limited Jurisdiction (Cal. Code Civ. Proc. 430.040) is DENIED. The Court notes that Defendant's interpretation of ICRAA relies on an unpublished federal case. Even if the Court accepted the argument that Plaintiff's statutory damages could not exceed $10,000, the prayer for punitive damages means that the amount in controversy does not necessarily fall below $35,000. =(501/CFH)
