Plaintiff Itria Ventures LLC's unopposed Motion for Summary Adjudication is GRANTED. Plaintiff carried its initial burden to establish each element of its causes of action for breach of contract and breach of guarantee entitling it to judgment on its third and fourth causes of action respectively. (See Code of Civil Procedure section 437c(p)(1); UMF ## 1-11.) The record does not support the viability of any defense to either claim. The court summarily adjudicates Plaintiff's third and fourth causes of action in favor of Plaintiffs and against Defendants. Notably, no defendant submitted any evidence or argument against Plaintiff's motion for summary adjudication of the third and fourth causes of action. (See California Rules of Court, rule 8.54(c) [party's failure to oppose a motion may be considered consent to the granting of the motion].)

The third cause of action (breach of contract) is summarily adjudicated in Itria's favor against Merchant Defendant in the amount of $178,548.16. The fourth cause of action (breach of guarantee) is summarily adjudicated in Itria's favor against the Guarantors in the amount of $178,548.16.

For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
