A review of the complaint shows that there are sufficient factual allegations to support the single cause of action for open book account. A review of defendant’s answer shows there are insufficient factual allegations to constitute a defense to the complaint. Thusly, judgment on the pleadings is proper in this instance.
Judgment in the amount of $9,886.29 is entered against defendant Joe Maldonado as to the first cause of action for open book account. The total judgment amount includes principal of $9530.29 plus costs of $356.00.
