Oak Park Estates Homeowners Association filed this action in September 2021 against the City of Pismo Beach and the International Church of the Four Square Gospel. The dispute concerns drainage issues on Oak Park Boulevard in Pismo Beach. The City and the Church have filed crosscomplaints against one another. The parties recently agreed to extend the deadline for bringing the action to trial indefinitely. In February 2026, the Church filed an action against the City regarding the same drainage issues reporting a water main break on January 30, 2025 (Case No. 26CV-0075, assigned to Hon. Craig B. van Rooyen).
On calendar is the Church’s motion to consolidate the two actions. No proof of service has been filed. The Court, however, notes this hearing was confirmed at the Case Management Conference on July 20, 2026, and all parties were present. In addition, the minutes for the August 13, 2026 Case Management Conference in case number 26CV-0075 state the parties agreed to a Case Management Conference in this department on September 16, 2026, to trail this motion; indicating the City does not oppose the motion.
Provided there is no objection at the hearing, the Court intends to grant the motion to consolidate pursuant to Code of Civil Procedure section 1048. The Court finds the two actions involve common questions of law or fact and consolidation would enhance trial court efficiency.
ORDER (PROPOSED)
Provided there is no objection, the Court grants the motion to consolidate. This action shall be the lead case. The Church is directed to file the consolidation order in both matters.
The Court confirms the Case Management Conference on September 16, 2026, at 9:00 a.m. in P2.
The parties should also come prepared to discuss whether the County of San Luis Obispo should be dismissed under Code of Civil Procedure sections 583.210 and 583.250, for lack of service.
