PLAINTIFF’S MOTIO FOR ENTRY OF JUDGMENT PURSUANT TO STIPULATION

TENTATIVE RULING:

The court GRANTS Equity Residential Management unopposed motion for entry of judgment pursuant to stipulation. The request for judicial notice is granted. The unopposed motion is granted pursuant to Code of Civil Procedure section 664.6.

The parties settled this action wherein defendant agreed to pay plaintiff $13,830.49 as principal plus $2,000 in attorney’s fees and court costs for a total of $15,830.49 as the “Balance.” It further provides that defendant shall make payments of $2,322.05 on April 15, 2026, and April 30, 2026. The parties also agreed that the court would retain jurisdiction to enforce the settlement agreement.

The declaration of Karen Webster states that defendants did not make the April 2026 payments. Accordingly, the defendant is in breach, and under the settlement agreement, plaintiff is entitled to a judgment of $15,830.49.

According, the dismissal of this action is vacated, and judgment is entered for plaintiff and against defendant Juan Camilo Romero Moissl in the amount of $15,830.49.

If the tentative ruling is uncontested, it shall become the order of the court. Thereafter, counsel for plaintiff shall prepare a written order and proposed judgment consistent with the court’s ruling for the court’s signature, pursuant to California Rules of Court, rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court.
