Plaintiffs Rosalind Arbel and Nir Arbel's unopposed Motion To Compel Deposition Of Trader Joe's Person Most Qualified Re Lighting is GRANTED.
Plaintiffs are suing Defendants for an injury Plaintiff Rosalind sustained while walking in a parking lot of a business called Lucky Penny, which is allegedly leased by Defendant Trader Joe's Company. Plaintiffs sued Defendants Dominic Yin and Helen Yin as trustees and individually for negligence and premises liability, alleging they owned the premises on which Plaintiff Rosalind tripped. Plaintiffs added Defendant Trader Joe's Company as a defendant in October of 2023.
Plaintiffs move to compel the lighting PMK deposition under CCP Section 2024.450(a) because Defendant Trader Joe's Company failed to object or appear for their noticed deposition. Plaintiffs demonstrated adequate meet and confer. It appears the discovery is reasonably calculated to lead to the discovery of admissible evidence. (Code of Civil Procedure section 2017.010.) Defendant failed to produce a witness. Defendant has not established the merit of any cognizable objection. Trader Joe's Company must produce its PMK re lighting for a deposition pursuant to the most recent deposition subpoena/notice and must do so at a date that works for the parties that must be on or before September 30, 2025. The court notes the trial date is November 10, 2025.
"If a motion under subdivision (a) is granted, the court shall impose a monetary sanction under Chapter 7 (commencing with Section 2023.010) in favor of the party who noticed the deposition and against the deponent or the party with whom the deponent is affiliated, unless the court finds that the one subject to the sanction acted with substantial justification or that other circumstances make the imposition of the sanction unjust." The record does not demonstrate Defendant Trader Joe's Company acted with substantial justification. Defendant Trader Joe's Company shall pay $1,160 in sanctions to Plaintiffs forthwith but no later than September 30, 2025.
