DEFENDANTS CLIPBOARD HEALTH LLC, AND TWOMAGNETS, LLC's Motion To Seal Portions Of Opposition To Motion For Preliminary Injunction. The unopposed motion by defendants Clipboard Health LLC and TwoMagnets LLC for an order sealing its opposition papers to plaintiff's motion for preliminary injunction is granted. These defendants seek to seal portions of Exhibit B to the Declaration of Michelle Alicante in Support of the Opposition to Plaintiff's Motion for Preliminary Injunction and portions of the Declaration of Wyatt Amaral in Support of the Opposition to Plaintiff's Motion for Preliminary Injunction.
The moving defendants have shown facts supporting their claim that the material sought to be sealed contains commercially sensitive information that they take steps to keep secret, and that denying this motion would likely result in competitive harm. The court finds based on facts in the Amaral Declaration submitted in support of this motion that (1) there exists an overriding interest that overcomes the right of public access to the record; (2) the overriding interest supports sealing the record; (3) a substantial probability exists that the overriding interest will be prejudiced if the record is not sealed; (4) the proposed sealing is narrowly tailored; and (5) no less restrictive means exist to achieve the overriding interest.
