TENTATIVE RULING: APPEARANCE REQUIRED. Appearances via Zoom or telephone are permitted. This motion was originally filed on July 2, 2025, and set for hearing on January 6, 2026. The parties requested a continuance of the hearing, and the motion was reset for September 3, 2026. Trial is presently scheduled to commence on October 20, 2026. On August 14, 2026, the date Plaintiff’s opposition to this motion was due, Plaintiff filed a “limited opposition” stating, in part: As of the filing of this Affidavit, Plaintiff, HEATHER RAMIREZ-KOTEY AKA HEATHER RAMIREZKOTEY (“Plaintiff”) and Defendant American Honda Motor Co, Inc. (“Defendant”; collectively, the “Parties”) have agreed to continue the hearing on Defendant’s Motion for Summary Adjudication (“MSA”) to sometime in December 2026, or a time thereafter convenient to the Court.

Contemporaneously with this Limited Opposition, the Parties are filing a Joint Stipulation requesting the continuance of the hearing on Defendant’s MSA.

Although Plaintiff’s limited opposition references a Joint Stipulation, no such stipulation appears in the Court’s electronic register. Furthermore, the proposed date for continuance would be after trial, mooting the purpose of this motion. Generally, a motion for summary adjudication must be heard no later than 30 days before trial. (Code Civ. Proc., § 437c, subd. (a)(3).) The parties are ordered to appear at the hearing to discuss proposed hearing dates for the motion for summary adjudication and related scheduling issues.

If no request for oral argument is made, the tentative ruling becomes the final order of the Court.

Unless ordered to appear in person by the Court, parties may appear remotely either telephonically or by video conference via the Zoom video/audio conference platform with notice to the Court and all other parties in accordance with Code of Civil Procedure §367.75. Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Court’s Approved Official Reporter Pro Tempore list.

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.
