Plaintiff’s Motion for Entering Judgment

The motion is denied. Plaintiff has not made a sufficient showing that the parties entered into a settlement agreement in this instance. The declaration of Spencer Penuela states that the parties entered into a settlement agreement on December 15, 2023. However, there is no signature of the plaintiff appearing on the settlement agreement. It is also noted that defendant’s signature has no electronic authorization to verify it is defendant’s signature. It is further noted that that Penuela declaration refers to the filing of a Notice of Settlement of Entire Action. The court file does not reflect any such notice was ever filed with the court. Moreover, defendant filed an answer on August 31, 2026, which asserts – among other things – the statute of limitations bars the claim. For these reasons, the motion is denied.
