DEFENDANT SVES GO, LLC'S MOTION TO COMPEL FURTHER RESPONSES TO REQUEST FOR PRODUCTION OF DOCUMENTS, SET ONE FROM THE GAP, INC., AND FOR SANCTIONS.
Insofar as SVES GO's motion seeks an order compelling Gap to produce in accord with its statement of compliance, a motion SVES GO brings under Code of Civil Procedure, section 2031.320, no meet and confer is required for such a motion but the court concludes that, because some production took place after the initial motion was filed, this dispute will also benefit from further informal resolution efforts.
SVES GO seeks sanctions, Gap does not. The failure to meet and confer before bringing a discovery motion is in itself sanctionable. (Code Civ. Proc., section 2030.010, subd. (i).)
The court orders SVES to show cause why it should not be sanctioned $500 payable to the court for prematurely bringing this discovery motion. That hearing shall take place on November 3, 2025. SVES GO may show cause why sanctions should not be imposed in a filing due five court days before the hearing. SVES GO's sanctions request against Gap remains to be resolved at the November 3 hearing as well.
