The unopposed motion to compel responses to discovery is granted and the court sets the matter on an order to show cause for September 25, 2025. The judgment debtor has not served responses and has not abided by the court's prior order to make objection-free responses. The judgment debtor is ordered to make objection-free responses within 10 days of entry of this order and to pay $60 to the judgment creditor within 30 days of entry of this order.
The judgment creditor asks for a much larger sanction in view of the judgment debtor's failure to abide by a prior order. The court issues an order to show cause to Vincent Vandell and his counsel why they should not be sanctioned $1000, payable to the court, for failure to comply with the court's May 5, 2025 discovery order. The OSC shall be set for hearing on September 25, 2025 at 9 am in Department 301. A response to the OSC may be filed no later than five court days before the hearing date. The judgment creditor is ordered to serve a copy of this order on the judgment debtor and to file his proof of service with the court.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept301tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
