NOTICE:

A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Court’s Approved Official Reporter Pro Tempore list.

Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporter’s Office and an official reporter will be provided.

The claim of exemption is GRANTED in part in that the levying officer is directed to withhold $100 per pay period, up to $200 per month, and to return to the judgment debtor any funds held greater than that amount forthwith.

The Court finds the judgment debtor has failed to establish that all wages are exempt from garnishment. Judgment debtor checked box 3(a) on the Claim of Exemption form, claiming that her earnings are below the legal minimum amount for an earnings withholding order under Code of Civil Procedure section 706.050. However, judgment creditor has submitted a copy of the Employer’s Return from judgment debtor’s employer Central Valley C-Stores, Inc., which states that judgment debtor’s gross earnings are $2,086.83 paid twice a month, which is more than the minimum amount under section 706.050.

The Court is also not persuaded that all of the earnings of the judgment debtor are necessary for support, and it appears that some of the claimed monthly expenses are excessive and/or not supported by any showing.

The employer may send one payment of $200 per month to avoid unnecessary administrative expenses. (Code of Civil Proc., § 706.025.)
