DEFENDANT MARYAM CHERKIS (ERRONEOUSLY SUED AS MARY CHERKIS) DEMURRER to COMPLAINT is SUSTAINED WITHOUT LEAVE TO AMEND, subject to opposition. Another action, Case No. CUD-25-678570, is pending between the same parties on the same cause of action. This is not a defect that can be cured by amending the Complaint in the present action.
The Complaint is also defective in two other respects. First, the Complaint alleges that Defendant's tenancy is subject to the SF Rent Ordinance, but does not allege that Defendant was served with any notice setting forth a just cause for eviction under SFRO 37.9 (a) or (b). Second, the Complaint is uncertain regarding the creation or existence of the license Plaintiff purportedly terminated as the basis for this action. =(501/CFH)
