Plaintiff's Motion for Entry of Judgment Pursuant to Stipulation is DENIED without prejudice. Motion is premature as defendant's August 1, 2025 request for reasonable accommodation was open and pending when the motion was filed. Per the supplemental declaration of plaintiff's counsel, said request remains unresolved as of October 2, 2025, as the parties are currently engaged in the interactive process. The Court notes that U.S. v. California Mobile Home Park Management Co. (9th Cir. 1994) 29 F.3d 1413, cited by plaintiff in reply, does not stand for the proposition plaintiff claims. =(501/CFH)
