Tentative Ruling - 08/28/2026 Han N. Tran

The Court orders the following after review of the case.

This action is on calendar for a 9/1/26 hearing on an Order to Show Cause re: Dismissal for Duplicative Complaint (CCP 430.10)

Plaintiffs filed two identical complaints against the same named defendants on 12/8/25: 25CV158472 and 25CV158346. Duplicative complaints violate Code of Civil Procedure section 430.10(c).

On 8/31/26, the clerk entered the dismissal of Case No. 25CV158472 without prejudice after plaintiffs filed a 8/31/26 request for dismissal.

As such, the Order to Show Cause is VACATED and DISCHARGED as moot.

The Order to Show Cause Re: Order to Show Cause re: Dismissal for Duplicative Complaint (CCP 430.10(c)) scheduled for 09/01/2026 is vacated.

Clerk is directed to serve copies of this order, with proof of service, to counsel and to selfrepresented parties of record.
