Defendants' Motion for Summary Judgment is OFF CALENDAR. Insufficient notice per CCP 437c(a)(2). The Court notes that there is no proof of service on file for July 16, 2025 hearing. If the motion was served on July 16, 2025, the motion would be untimely.
The Court further notes that any claim that July 14, 2025 version of the motion (which attempted to set the hearing in department 505 for August 12, 2025), assuming it was in fact served (not clear based on Paragraph 8 of Toles Declaration filed on September 19, 2025), would have provided sufficient notice, is not supported by the law. The Court declines moving parties' invitation to disregard the law based on unsupported by any authority argument that the rules regarding notice are "zombified." =(501/CFH)

Notice of contesting a tentative ruling shall be provided by sending an email to the court to Department501ContestTR@sftc.org with a copy to all other parties stating, without argument, the portion(s) of the tentative ruling that the party contests.
