Tentative Ruling
Defendants SDS Agency, Inc. (SDS) and Sam Mohammads (Mohammad) (collectively, Defendants) motion for summary adjudication of Plaintiff Michelle Stokes (Plaintiff) second cause of action is UNOPPOSED and is GRANTED.
Plaintiff alleges that she was injured when she was being transported to a medical appointment by Mohammed, SDS driver. Defendants move for summary adjudication of the second cause of action for medical malpractice on the ground that it is undisputed that the alleged negligence arose from ordinary driving conduct rather than the rendering of professional medical services. (Motion, 2:6-8; UMFs 18-21.)
Plaintiff filed a non-opposition. Plaintiff concedes that SDS is not a health care provider in the traditional sense; as they do not provide medical care such as doctors, nurses, clinics or hospitals, this company is a registered non-emergency medical transportation services provider. (Plaintiffs Non-Opposition, 2:1-3.) Plaintiff request that the Court grant leave to amend to clarify any issues that arise where portions of the Complaint are no longer viable. (Id., 2:4-5.)
Given the non-opposition, the motion for summary adjudication is GRANTED.
Plaintiffs request for leave to amend is denied. Plaintiff must file an appropriately noticed motion for leave to file an amended complaint if she wishes to amend.
This minute order is effective immediately. Defendants shall prepare a formal order pursuant to California Rules of Court, rule 3.1312 and Code of Civil Procedure section 437c(g).

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. Parties may contact Court- Approved Official Reporters Pro Tempore by utilizing the list of Court Approved Official Reporters Pro Tempore available at https://saccourt.ca.gov/home/showpublisheddocument/227/639084034465370000.
A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
